Terms of Use

The agreement governing use of the Genfora marketplace.

Genfora provides a technology marketplace connecting customers and independent service professionals. Genfora does not perform the services, does not employ Pros, and does not supervise the work they carry out.

Introduction

These Terms govern access to and use of the Genfora website, applications, marketplace, communications tools and related services.

By creating an account, accessing Genfora, submitting a service request, responding to a request, or otherwise using the platform, you agree to these Terms and the policies incorporated into them.

Platform role

Genfora provides a technology marketplace connecting customers who need services with independent service professionals. Genfora does not perform the underlying services and is not a party to the service contract formed between a customer and a Pro.

The customer selects the Pro. The Pro decides whether to accept work and is responsible for negotiating the scope, price, timing and performance of the service.

Genfora does not guarantee:

  • availability of any Pro or customer
  • project completion, workmanship or project outcome
  • quoted price or arrival time
  • licensing status, unless expressly verified
  • insurance coverage, unless expressly verified
  • identity beyond the scope of an indicated verification
  • suitability of any user, customer payment, or Pro performance

User responsibilities

Users must provide accurate account and project information, and are responsible for deciding whether another user is appropriate for their project.

Users may not:

  • impersonate another person or create fraudulent requests
  • intentionally misrepresent project scope
  • harass, threaten or unlawfully discriminate against another user
  • submit illegal projects or attempt fraud
  • manipulate reviews or abuse refund systems
  • scrape platform data, bypass platform security or attempt unauthorized database access
  • distribute malware or use Genfora for unlawful activity

Customer terms

Customers may submit requests describing services they need. Genfora may distribute a request to one or more eligible Pros. Receiving Pro responses does not guarantee that a Pro will accept, schedule or complete the project.

Customers may communicate with multiple Pros before selecting one, and are solely responsible for selecting the Pro.

Before work begins, the customer and Pro should confirm scope, price, materials, schedule, access requirements, permits where applicable, and cancellation terms.

Service pricing displayed by a Pro may be an estimate and may depend on the final project scope. Genfora does not set the final service contract price unless a specific Genfora feature expressly states otherwise.

Reviews

Only eligible customers may submit reviews, based on legitimate marketplace interactions, with one review per eligible job. Fake, purchased, retaliatory, self-authored or coordinated reviews are prohibited. Genfora may remove reviews that violate policy and does not promise that every review will remain published.

Electronic communications

By using Genfora you consent to receive operational electronic communications necessary to use the service, including account notices, lead notifications, customer messages, transaction notices, security alerts and policy notices.

Marketing communications are governed by separate consent and unsubscribe requirements. Mandatory transactional notices are not marketing consent.

Platform enforcement

Genfora may investigate and take proportionate action for fraud, safety concerns, abusive behavior, payment abuse, policy violations, fake accounts, manipulation, illegal conduct or threats to platform integrity. Actions may include a warning, content removal, feature restriction, temporary suspension or permanent termination. Genfora preserves appropriate internal audit history.

Minors

Genfora accounts and marketplace transactions are limited to users legally capable of entering the relevant agreements. Genfora does not market Pro accounts to children.

Disclaimers

To the maximum extent permitted by applicable law, platform services are provided on an "as available" basis. Genfora does not warrant that every user is suitable, that every project will occur, that every service will be satisfactory, that every Pro credential remains current, that every customer will act appropriately, or that the platform will be uninterrupted.

Limitation of liability

To the maximum extent permitted by applicable law, Genfora is not liable for indirect, incidental, consequential, special or punitive damages arising out of or related to use of the platform, including damages arising from the acts or omissions of another user.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

Indemnification

This section is pending final review by legal counsel before it is relied upon.

To the maximum extent permitted by applicable law, each user agrees to indemnify Genfora against claims arising from that user's services, conduct, content, violation of law, violation of these Terms, or infringement of third-party rights.

Disputes and governing law

This section is pending final review by legal counsel before it is relied upon.

Applicable governing law, venue and dispute procedures are subject to the final published Terms. Genfora has not adopted a mandatory arbitration provision or class-action waiver in this version.

This section requires final counsel approval before production reliance.

Intellectual property

Genfora branding, software, platform design and proprietary technology are owned by or licensed to Genfora and A&E The Rich Twin LLC. Users may not copy, reverse engineer where prohibited, scrape, resell or reproduce protected platform assets except where permitted by law.

Changes to these Terms

Genfora may publish new versions of these Terms. Published versions are preserved with their version number and effective date, and materially important changes may require renewed consent before continued use.
